DC/Marvel Trademarking 'Super Hero'

A posting on Kevin Smith's Newsarama.com Web site reported that the two largest publishers of comics, DC and Marvel, are trying to trademark the term "super hero." In a post, the site reported that GeekPunk, an independent publisher of comics, has already received a letter from DC and Marvel's trademark lawyer asking it to stop using the term "super hero" in its title Super Hero Happy Hour, about a bar and grill patronized by costumed heroes. The company complied, changing the name of the title to Hero Happy Hour. Dan Taylor created the critically acclaimed comic.

"The decision to change the title was brought [about] by the fact that we received a letter from the trademark counsel to 'the two big comic book companies' claiming that they are the joint owners of the trademark 'super heroes' and variations thereof," Taylor said in a statement.
